ORDINANCE NO. 11470

AN ORDINANCE TO AMEND PART II, CHATTANOOGA CITY CODE, PART II, CHAPTER 31, ARTICLE VIII, DIVISION 8, SECTION 31-321, RELATIVE TO THE REGULATION OF LAND-DISTURBING ACTIVITY.

                        SECTION 1.   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Part II, Chattanooga City Code, Chapter 31, Article VII, Division 8, Section 31-321(a)(5) be amended by deleting therefrom the phrase “forestry land management practices including harvesting.” 

                        Said section is further amended by adding a new subsection (b) set forth below and renumbering the existing subsection (b) as subsection (c).

“(b)      Forestry Land Management Practices.  The harvesting or removal of timber from a forested site shall require a land-disturbing permit if the following conditions exist:

(1)        The forested site is one (1) acre or larger in size;

(2)        More than ten percent (10%) of the timber on a forested site is harvested, cut, or removed within any 365-day period;

For purposes of this section, timber is defined as being a tree of a size greater than four-inch (4”) diameter at a height of five (5) feet from ground level.  A forested site is defined as a dense growth of trees and underbrush.”
